This Event Liability & Safety Disclaimer applies to all events listed on GatherRound, whether hosted by individuals or businesses.
GatherRound is operated by Ninety2 LLC, based in Fairfax County, Virginia.
1. Role of GatherRound
GatherRound is a listing and discovery platform only.
We:
- Provide tools for users to create and discover events
- Enable RSVPs, messaging, and ratings
- Offer optional identity verification through third parties
We do not:
- Organize or host events
- Supervise attendees
- Control event locations
- Verify venues, safety conditions, or compliance with laws
- Guarantee the conduct of any user, host, or business
All events are independently organized by users or businesses.
2. Host Responsibility
Individual Hosts
If you host an event, you are solely responsible for:
- The accuracy of your event listing
- The safety and suitability of the location
- Compliance with local laws and venue rules
- Managing attendance and behavior
- Setting and enforcing age restrictions
Hosting an event at a private residence carries additional responsibility and risk.
Business Hosts
If you host events as a business, you are responsible for:
- Maintaining appropriate licenses and permits
- Ensuring venue safety and accessibility
- Carrying any required insurance
- Complying with employment, zoning, and safety regulations
GatherRound does not verify business compliance or insurance coverage.
3. Attendee Responsibility
By attending an event, you acknowledge that:
- You are voluntarily meeting people you may not know
- In-person events involve inherent risks
- You are responsible for your own safety, conduct, and belongings
You agree to:
- Follow host and venue rules
- Act respectfully toward others
- Leave an event if you feel unsafe
Attendance is entirely at your own risk.
4. Minors & Guardian Responsibility
- Users under 18 must have permission from a parent or legal guardian to attend events.
- GatherRound does not verify guardian approval.
- Hosts are not required to supervise minors unless explicitly stated.
- Parents and guardians are solely responsible for determining whether an event is appropriate.
GatherRound strongly discourages minors from attending private, home-hosted events without a guardian present.
5. Identity Verification Disclaimer
Some users may display a "Verified" badge based on Stripe Identity verification.
Important clarifications:
- Verification confirms identity documents only
- It does not indicate background checks
- It does not guarantee safety, trustworthiness, or intent
- Verified users may still behave inappropriately
Do not rely solely on verification when making safety decisions.
6. Assumption of Risk
By hosting or attending an event listed on GatherRound, you voluntarily assume all risks associated with:
- In-person interaction
- Physical activity
- Venue conditions
- Travel to and from events
- Actions of other attendees
7. Limitation of Liability
To the fullest extent permitted by law, Ninety2 LLC shall not be liable for:
- Personal injury or death
- Property damage or loss
- Emotional distress
- Criminal acts of users
- Disputes between users
- Accidents occurring before, during, or after events
8. Indemnification
You agree to indemnify and hold harmless Ninety2 LLC from any claims, damages, losses, or expenses arising out of:
- Events you host
- Events you attend
- Violations of these terms
- Your interactions with other users
9. Reporting & Emergencies
- For emergencies, contact local emergency services immediately.
- Safety concerns should be reported through GatherRound's reporting tools.
- GatherRound may remove events or accounts based on safety concerns but has no duty to monitor events in real time.
10. Governing Law
This disclaimer is governed by the laws of the Commonwealth of Virginia.
Any disputes must be brought in courts located in Fairfax County, Virginia.
